Terms of use

These terms apply to using Octopus and to buying its license. Octopus is sold by Smartery LLC, 222 Yamato Rd, Ste 106-198, Boca Raton, FL 33432, USA.

Free trial

Each computer can use Octopus for 7 days free, with no sign-up and no card. One trial per computer.

The license

The license lets you use Octopus for one year, on up to 2 computers running macOS, Windows or Linux, with every update released that year. The year starts at the purchase, or at the end of the license you already have if it is still running. The license is yours: don't resell or share the key.

Price and payment

US$ 97 per year (R$ 497 in Brazil), paid once through Stripe, by card or the other methods Stripe's checkout shows. There is no subscription and no automatic renewal: near the end of the year the app tells you, and you renew if you want to. When the license ends, the app locks until it is renewed, without deleting anything.

Refunds

You can cancel the purchase within 7 days and get your money back, no questions asked: write to contact@smartery.tech. Once refunded, the license is turned off.

Responsible use

Octopus runs the agents and commands you ask for, on your machines and accounts (servers, cloud, repositories). You are responsible for what is done with them. Use the app's permission modes with care, especially in production.

Third-party services

Claude Code, Codex, Google Cloud, Gemini and Stripe have their own terms, which apply to using them.

Warranty and liability

We do our best for Octopus to work well and we fix the problems that come up, but we don't guarantee it will work without any failure. To the extent the law allows, our liability is limited to what you paid for the license in the last 12 months. Nothing here takes away the rights consumer law gives you.

Termination

We may turn off licenses obtained through fraud, through an unfounded payment dispute, or used against these terms.

Law and contact

These terms follow the laws of the State of Delaware, USA, without taking away the rights the law of your country gives you as a consumer. Questions: contact@smartery.tech.
